Colorado Springs man faces sex crimes accusations

A Colorado Springs man, 28, has been arrested as part of an investigation into child pornography and sexual exploitation of children.

Law enforcement authorities have charged him with sexually assaulting an infant.

The child was 11 months old when the sexual assault allegedly took place in a motel, according to authorities. While the arrest was made by Colorado Springs police officers armed with an arrest warrant, the arrestee is currently in federal custody and facing federal criminal charges of child sexual exploitation.

The investigation that led to the arrest was initiated after the discovery by law enforcement officials of a pornography video during a separate arrest.

The recording appeared to depict the rape of a baby by a grown man.

Because the videotape showed a commercial playing on a television in the room at the same time as the rape, investigators were able to determine that the recording was made on March 28, 2009; the only date the commercial aired.

They say they were ultimately also able to determine the location of the hotel at which the incident occurred.

Through further investigation, they found the motel at which the video was shot and identified the arrestee as the suspect depicted, based on motel receipts.

Investigators said that the child belonged to a family in an area that the arrestee sometimes traveled to for work-related purposes. They allege that he waited until the parents were asleep before moving the child to the motel room where the sexual assault purportedly took place.

There aren’t many criminal charges more serious than the ones this defendant faces. But we must always remember that regardless of the charges, the defendant is entitled to a presumption of innocence. We don’t know that the charges are true or accurate or that the defendant’s rights have been observed by law enforcement.

The state has the burden of proving the charges in a court of law and the defendant has every right to an effective, vigorous defense to counter those charges.
