Colorado man charged with six counts involving child pornography

A 38-year-old man from an area north of Colorado Springs and El Paso County was charged with production and transportation of child pornography and indicted by a federal grand jury in Denver.

The Douglas County man was arrested in July, but indicted on the charges in mid August.

Police officials said they rescued a minor child who had been allegedly kidnapped and used by the man to produce child pornography.

According to court documents, between Sept. and Dec. 2006, the man used the minor to engage in sexually explicit content for the purpose of producing pornography, and then transported the content to other states and across international borders. The man also allegedly produced more than 50 images of child pornography.

Included in the indictment is asset forfeiture including the forfeiture of all digital and non-digital formats, and any property used to carry out the crime, which includes a residence in the city of Parker.

During the court appointment, the man pled not guilty to all charges.

Currently, the man is being held in federal custody without bond. If convicted on the five counts of producing child pornography, he could face 15 to 30 years in prison and a fine of no more than $250,000 per charge. If convicted of transportation of child pornography, the man faces five to 20 years of prison with a fine of up to $250,000.

The charges and penalties are serious. The defendant could lose not only his freedom for years, but also his house. That means his criminal defense team must be as serious as the charges, taking a close look at how the evidence was gathered, whether the evidence truly points to him and whether someone else might actually be responsible for any illegal acts.
